Terms and Conditions

These Terms & Conditions form the basis of a contract between you and Money Moon Pty Ltd (“us” or “we” or “our”), trading as “Chuyen Tien Tiet Kiem” and apply to your use of the Services.

you will not be able to use our Services if you do not agree with this Terms and Conditions

By using the Services, you agree and accept all the Terms & Conditions. The Terms & Conditions are provided to you in English. You agree that by using any of the Services, this constitutes your acceptance of the Terms & Conditions.

Definitions

For your better understading, we explain the following terms that we are using to describe our service:

A. Your rights and obligations

  1. In order to use the service, you must be at least 18 years of age having income in Australia with personal Australian bank account under your name. You also need to have the legal capacity to form a legally binding contract in Australia

  2. For each Transaction Request that you submit, you will pay us the relevant Service Fee in addition to the Transaction Amount. Payment of the Service Fee is required at the time that you submit your Transaction Request. To the maximum extent permitted by law, the Service Fee is non-refundable unless explicitly stated in these Terms & Conditions.

  3. If you submit a Transaction Request that results in us becoming liable for charges, including but not limited to a credit card chargeback or other similar fee, you agree to reimburse us for all such charges.

  4. A processing credit card payment fee will be applied if you decide to proceed with it. 

  5. You will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Services or any Transaction Request being processed through the Services.

  6. In connection with any Transaction Request and your use of the Services, you will:

    1. provide us with true, accurate, current and complete information about your identity, and

    2. provide us with any identification and supporting documents as may be requested by us;

    3. provide us with details of your Payment Method;

    4. provide us with true, accurate, current and complete information as is required to use the Services and any other information which may be required in relation to the Receiver; and

    5. provide us with any other information that we consider must be provided for a Transaction Request to be properly executed, as specified when you enter or provide the details of the Transaction Request.

    6. provide an email address that you are the owner of and have access to. If you wish to update your email address you can request by contacting us.

  7. You are required to to make sure all the information is correct before submitting a request for using the service. You will have a review section before confirming the request.. 

  8. All the detail of the transaction will be shown on the website or in email sent to you. By paying the Total Amount, which includes the Send Amount and Fees, you agree that the details of the Transaction Request are correct.

  9. If you find the request has not been properly executed by us, you can submit a disput through info@chuyentientietkiem.com with your full information of the transaction, Our Team will conduct an investigation accordingly. All the disputes must be reported within 1 month from the time of the day making the Transaction Request.

  10. We guarantee that the Payout Amount is the amount of fund that we pay out to the Receiver’s bank account. However, Money Moon PTY LTD will not be liable for any fees or charges or deductions incurred on the Payout Amount by any intermediary, correspondent or receiver bank. In case the Receiver’s account is denominated in a different currency from the Transaction Request, the fund ending up in the account might be different. It is your responsible for ensuring that the information you submitted is correct

  11. To combat with unethical, illegalm and fraudulent activities, you must only use the Service to send money to people that you personally know. You must not send money on behalf of other people unless you have the appropriate authorisation or approved to do so. 

  12. The Service is designed to help with your personal money transfer demands. If you use the Service to pay for goods or services. We are not responsible for the safety, quality, delivery, and legality of those goods or services. 

  13. Both you and the Receiver will only act on your own behalf. You may not submit a Transaction Request or receive a transaction on behalf of a third person without our prior approval. If you wish to submit a Transaction Request or receive a Payout Amount as a Receiver on behalf of a third party, you must first inform Money Moon PTY LTD of your desire to do so  by sending an email to info@chuyentientietkiem.com and provide us with any additional information and documentation about the third-party that we may request for us to decide whether to proceed with the Transaction Request.

  14. In using the Services, you will comply with these Terms & Conditions and any applicable laws, rules or regulations. It is a breach of these Terms & Conditions to use the Services to initiate Transaction Requests:

    1. to a Customer or Receiver who has violated these Terms & Conditions, or

    2. in connection with what we consider to be fraudulent, illegal or unethical activity including but not limited to money laundering or terrorism financing.

  15. If we reasonably believes you are using the Services in connection with any of these or other with fraudulent, illegal or unethical activities, or are permitting a third-party to do so, we may cancel the transaction, cease to deal with you as a customer and report you to the appropriate authorities. When using the Services at our websites, or at our branches, you must not:

  16. If we reasonably believe you misuse the Service for any of unethical or ilegal purposes, we will terminate your account registered with us, cancel the transaction and report you to the appropriate authorities. You must not, when using the Service at our website or at our branches,: 

    1. violate this Terms & Conditions or any other agreement between you and Money Moon PTY LTD;

    2. provide false, inaccurate, or misleading information in regards to your identity as the customer or the Receiver;

    3. allow anyone else access to or to use in any way your Account Details with Money Moon PTY LTD and you will keep those Account Details safe and secure;

    4. refuse to provide clarification or confirmation of any information you provide to us, including proof of identity, proof of source of wealth, or refuse to cooperate in any compliance review or investigation we may conduct;

    5. create more than one online account without our prior written permission;

    6. use an anonymising proxy, disposable email to register account on our websites;

    7. copy or monitor our websites using any robot, spider or other automatic device or manual process; or

    8. use our services to provide remittance services to others without a contractual arrangement as an Affiliate or a partner, and the necessary registrations with the relevant authorities.

  17. You need to consult your own professional advisers if you want to use any information on our website as legal or other advice. Money Moon PTY LTD will not be responsible for any damages or loss because of that regards.

  18. You acknowledge that your personal information including your name, address, date of birth, and legal documents will be electronically stored and verified by a third party, government approved gateway provider

B. Our rights and obligations

  1. Money Moon PTY LTD has the right to frozen, delay, block, or refuse to initiate the transaction if we believe that they breach Australian laws, or because of some malfunction, system errors, or technical reasons. We have rights to not disclose the specific reason to you. 

  2. Here are some examples of when that may occur.

    1. If we believe that you misuse the system for illegal purposes or unethical activities. 

    2. If becuase of a technical issue that we can not control, the Exchange Rate at our branch or on our website is significantly, unreasonably higher/lower than the correct fee or Exchange Rate at that particular point in time.

    3. You use our service to provide remittance services without any agreement between you and us.

    4. If the Receiver is on any sanction lists or watch lists or in case sending money to that person against the local laws and regulations.

    5. If you use the Service to buy or subscribe to a goods or services that against the local laws

    6. We might, refuse or cancel a Transaction Request if:

      • You do not have the valid ID with you 

      • we are unable to provide the Receiver’s identity information; especially in case you use cash pick up as your payout method. 

      • You refuse to provide additional information and documents when required.

      • you send money to us from the bank account that is not your personal bank account or use other person’s credit card

  3. Before terminating the Account Registration and Transaction Request with you, Money Moon PTY LTD will keep all the transaction Fees before refund the Sending Amount back to you.

  4. We are not liable for any unauthorised overdraft fees incurred by your action. That includes the interest generated by using your credit card. We only liable for the fund you send showing up in our system and bank account.

  5. The Receiver often receive the payout within 0-3 business days since we receive the full payment from you. However, there are some situations are not under our control, which are not limited to:

    1. Bank or public holidays;

    2. Technical problems from our partners;

    3. Natural disasters; or

    4. Labour issues or strikes.

  6. The full Payout Amount will be sent from our bank account to the Receiver’s bank account. We are not responsible for any additional fees, but not limited to, charged by the Receiver’s bank account.

  7. We are not responsible for any losses or damages to you ir any third party because of delaying the payment from you that because you are not complying with our Terms and Services, or in the timeframe that we promised you to pay out to the Receiver’s bank account. 

  8. To comply with the laws, we have the right to ask you to provide us with additional documents and information related to the transaction and information that we collected from you not limited to verify your source of fund.

  10. If we fail to send the money in time as we promise you, we will initiate the transaction fees refund to your personal bank account 

  11. Because of the nature of the exchange rate, we can only guarantee the rate if you can make the transaction in 1 hour after you make the Transaction Request on our website. Otherwise, if the currency Exchange Rate is the same, we will conduct the transaction. In case it changes, we will inform you about it.

  12. If you do not make the transaction within 1 hour timeframe from the moment you make Transaction Request and you do not agree with the new rate if it changes, we have right to cancel the transaction.

  13. We have a best-rate guarantee policy for currency exchange to match or beat a competitor’s overall price and may apply this policy when the following conditions are met:

  14. We guarantee to have the best rate in the market. We will match the Exchange Rate of them or we will refund you the Transaction Fees only if:

    • They have at least 1 physical store

    • At the time of making Transactional Request, that store have better Exchange Rate than us

    • There is no extra or hidden cost, or commision leads to unfair competition

    • We can verify their information

C. Your rights to cancel the transaction and to access a refund

  1. If you want to cancel the transaction, you can email us via: info@chuyentientietkiem.com to let us know as soon as possible. In case we already sent out the fund to your Receivers, we are unable to refund the amount to you. Depending on the payment method that you pick, the refund amount will be returned to you within 0-3 business days. 

  2. If you are not the person who make the Transaction Request, please contact us through info@chuyentientietkiem.com immediately. Our team will conduct an investigation and temporary close the account for you and help you change the password.

  3. A request for a refund must be submitted to one of the contact points listed at the end of these Terms & Conditions giving the Customer's full name, address, and phone number, together with the Transaction Request number, Transaction Amount and the reason for your refund request.

  4. In case there is incorrect information with the Transaction Request that you submitted or you has been the victim of a scam or fraud, we will try to recover the funds for you but we are not liable for the result of the return. We might charge you a reasonable fee to help you recover it. 

  5. If Money Moon PTY LTD make any mistakes that not following the Transaction Request that you submitted, we will refund the full amount or making another transaction that you requested immediately after we notice.

D. Communications

We will contact you by one or both of the following:

  • Your phone number

  • Your email address

Those information will be collected at the time you register your account on our website. We might send you the transaction information and some promotions from time to time but will not spam you. 

In case we need additional information from you, we will call you to let you know immediately. 

E. System Maintenance

In case we maintain our system, we will try our best let you know a day in advance unless there is a major technical issue. The detail on how you can process your Transaction Request will be update to you at the time. We will try not to delay and continue to provide the service during the maintenance period.

F. Fees

Besides the transaction Fees that we charge for the Service, if you want to cancel your Trasfer Request, we might charge you $19/cancellation for our administrative cost.

G. General

  1. If there is a mismatch between the translated version of this Terms & Conditions and the English version,  the English text shall be binding.

  2. The contract between you and us is governed by the laws of Victoria, Australia and the parties irrevocably and unconditionally submit to the jurisdiction of the courts of Victoria, Australia.

  3. This contract will be only modified with written agreement from both parties. 

  4. The consent of Money Moon PTY LTD to anything under these Terms & Conditions may be withheld in Money Moon PTY LTD’s absolute discretion.

  5. Any part of the Terms & Conditions, which is wholly or partially void or unenforceable, is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of the Terms & Conditions is not affected.

  6. The Terms & Conditions constitute the entire agreement between you and us with respect to its subject matter and supersedes all prior communications and negotiations between you and us.
